Dispute Resolution

This clause does not prevent either party from seeking injunctive relief or emergency remedies in a court of competent jurisdiction, nor does it prevent either party from bringing an action in court for claims related to intellectual property infringement or the unauthorized use of data.

Force Majeure

Bitter Creek Investments shall not be liable for any failure or delay in performance under these Terms due to causes beyond its reasonable control, including, but not limited to, acts of God, natural disasters, war, terrorism, labor disputes, governmental actions, power failures, or internet service interruptions.

Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. You agree that any disputes arising out of or relating to your use of this website or services shall be resolved exclusively in the state courts located in Nolan County, Texas, or the federal courts of the Northern District of Texas, as applicable. To the extent permitted by law, you waive any objection to such venue as inconvenient or improper.
